Legal responsbilty of doctors for a prescription in which DEATH occured...?

My daughter's father wsa found dead on the morning of 8/16/10...he died in his sleep of an apparent overdose. Upon searching his room, 2 bottles of pills were found. One was oxymorphone and the other, xanax. They were not prescribed to him at all however i feel like soeone should be held responsible for his death. Yes, ultimatley, he took the pills but the fact that pills that are so dangerous were so negligently prescribed...they were two HUGE (not sure of exact qty) bottles of pills!!!!!!!!!! 2 different pharmacies in 2 sep counties however and the name was ripped off but the pharm name was still on...i would like to hear what you know or opinion on the matter....so heartbreaking and such a waste of a young TALENTED man...he was only 26 with a 5 yr old baby girl =(
